1. Introduction
These Terms of Service ("Terms") govern your access to and use of Keldo and related services available through keldo.app.
Keldo is operated by Keldo Technologies Pty Ltd ("Keldo", "we", "our" or "us").
By accessing or using Keldo, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the platform.
2. About Keldo
Keldo is a platform that helps clubs and organisations manage programs, competitions, registrations, payments, communications, scheduling, participant records and related activities.
Keldo may also provide communication tools including email, SMS, WhatsApp and other messaging services.
Features may change over time and may vary between organisations.
3. Pilot and Beta Services
Keldo is currently being developed and may be operating in pilot, beta or early-access environments.
You acknowledge that:
- Features may be added, modified or removed at any time
- Functionality may change without notice
- Services may contain errors, defects or incomplete functionality
- Documentation and support materials may be updated regularly
We may make changes to improve the platform, address issues or support new functionality.
4. Accounts and Access
Access to Keldo is generally provided through clubs and organisations that use the platform.
Creating an account does not automatically provide access to any club, organisation, competition or program.
Users may only access information and functionality that has been made available to them by the relevant club or organisation.
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring information provided is accurate and current
- Any activity occurring under your account
5. Acceptable Use
You must not:
- Use Keldo for unlawful purposes
- Attempt to gain unauthorised access to systems or data
- Interfere with the operation or security of the platform
- Upload malicious software or harmful content
- Use Keldo to send spam, unsolicited communications or misleading messages
- Misrepresent your identity or authority
We may suspend or terminate access where we reasonably believe these Terms have been breached.
6. Communications
Keldo may facilitate communications including:
- Registration confirmations
- Competition updates
- Match reminders
- Schedule changes
- Program notifications
- Administrative communications
- Email, SMS, WhatsApp and other messaging services
Communications may be sent directly by Keldo or on behalf of clubs and organisations using the platform.
Users are responsible for ensuring their contact details remain current.
7. Payments
Keldo may provide functionality that allows clubs and organisations to accept payments from participants.
Payment processing may be provided through third-party providers such as Stripe.
Keldo does not act as a bank, financial institution or payment processor.
Funds processed through third-party payment providers do not pass through Keldo's accounts unless explicitly stated otherwise.
Additional terms may apply to payment-related services.
8. Data Ownership
Clubs and organisations retain ownership of their data.
Keldo does not claim ownership of information, records, content or participant data entered into the platform by users.
By using Keldo, you grant us the rights reasonably necessary to host, process, store, transmit and display data for the purpose of providing the services.
9. Privacy
Our collection, use and handling of personal information is governed by our Privacy Policy.
By using Keldo, you acknowledge and agree to the practices described in that Privacy Policy.
10. Third-Party Services
Keldo may integrate with third-party providers including payment, communication, hosting, analytics and infrastructure services.
We are not responsible for the products, services or policies of third-party providers.
Your use of third-party services may also be subject to their own terms and policies.
11. Children's Participation
Keldo may be used by clubs and organisations that support junior participants.
Parents, guardians and participating organisations are responsible for ensuring appropriate permissions and consents are obtained where required.
12. Availability
We aim to provide reliable access to Keldo but do not guarantee uninterrupted availability.
Keldo may be unavailable from time to time due to:
- Maintenance
- Updates
- Infrastructure issues
- Third-party service interruptions
- Events outside our reasonable control
We do not provide any service level agreement unless separately agreed in writing.
13. Intellectual Property
Keldo, including its software, design, branding, content and underlying technology, remains the property of Keldo Technologies Pty Ltd or its licensors.
These Terms do not transfer any intellectual property rights to users.
14. Suspension and Termination
We may suspend or terminate access to Keldo at any time where:
- These Terms are breached
- The platform is being misused
- Continued access presents a security, legal or operational risk
- We discontinue part or all of the service
Users may stop using Keldo at any time.
15. Disclaimer
Keldo is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we exclude all warranties, representations and guarantees not expressly stated in these Terms.
We do not guarantee that:
- Keldo will be error free
- Keldo will always be available
- Keldo will meet every user requirement
- Data will never be lost or corrupted
16. Limitation of Liability
To the maximum extent permitted by law, Keldo Technologies Pty Ltd is not liable for any indirect, incidental, consequential, special or punitive loss or damage arising from the use of Keldo.
This includes loss of:
- Revenue
- Profits
- Data
- Business opportunities
- Goodwill
Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted under applicable law.
17. Changes to These Terms
We may update these Terms from time to time.
Updated versions will be published on this page together with a revised effective date.
Continued use of Keldo following publication of updated Terms constitutes acceptance of those changes.
18. Governing Law
These Terms are governed by the laws of Australia.
Any disputes relating to these Terms will be subject to the jurisdiction of the Australian courts.
